Dispute resolution – amicable settlement prerequisite
Our law firm is pleased to announce that in an energy legal case, the Single-Member Court of Piraeus has issued decision No. 418/2022, in which it annulled a payment order, because the claimant ignored the parties’ agreement provided for in the contract for the sale of electricity, for an out-of-court settlement to precede any legal action. This decision is of wider legal importance (also in the field of mediation), as it was ruled by the Court that agreements to try an out-of-court settlement prior to commencing any legal action, are valid procedural law contracts, provided that they do not hinder free access to Justice, in the form of the “natural judge”.
